Terms of Service (Updated May 6, 2025)

Bath Mira is a company organised under the laws of China with its office at Guangzhou, Guangdong, China. We sell raw materials, semi-finished and finished goods worldwide through the Site https://www.bathmira.com (the “Site”). Throughout this Policy “we”, “us”, “our” and “Bath Mira” mean Bath Mira; “you” and “your” mean any visitor or purchaser located anywhere in the world.

1. Purpose of This Policy

We explain what Personal Data we collect, why we collect it, how we use it, the limited circumstances in which we share it, the security we use, and the rights you have under applicable global privacy laws including, without limitation, the People’s Republic of China Personal Information Protection Law (“PIPL”), the EU and UK General Data Protection Regulation (“GDPR”), the California Consumer Privacy Act as amended (“CCPA/CPRA”), Brazil LGPD and similar statutes. By using the Site or placing an order you acknowledge that you have read and understood this Policy.

2. Legal Bases for Processing (GDPR / LGPD users)

We process Personal Data only when the law allows us to. Most commonly we rely on:
a. Contract – to take steps at your request before entering a sales contract and to perform that contract (shipping, payment, returns).
b. Legitimate Interests – to prevent fraud, maintain security, improve products, and market similar goods to existing customers (you may object at any time).
c. Legal Obligation – to comply with Chinese export law, EU REACH, US FDA, tax, customs or accounting rules.
d. Consent – for sending promotional e-mails to non-customers, placing non-essential cookies, or collecting sensitive data (e.g., health-related information you voluntarily supply).

3. Personal Data We Collect

A. Data you give us: name, billing/shipping address, e-mail, telephone, payment details, order contents, any information you enter in messages, reviews, or upload (e.g., photos).
B. Automatically collected data: IP address, device identifiers, browser type, referring pages, dates/times, cookies and similar technologies (see Section 9).
C. Optional data: marketing preferences, survey answers, product usage you choose to share.

4. Special Note on Sensitive Data

We do not intentionally collect “sensitive” data such as racial, religious, health or biometric data. If you volunteer it (for example, by telling us about a skin condition when asking for formulation advice) you explicitly consent to our limited use of that information solely to respond to your request.

5. Global Sales & Buyer Responsibility

We sell globally; however, it is solely your responsibility to determine whether any product may lawfully be imported into your jurisdiction and whether it satisfies local standards, labelling, certification or warning requirements.Examples include but are not limited to:
United States – California Proposition 65 warnings; TSCA compliance; FDA cosmetic / OTC rules.
European Union & UK – REACH registration, CLP labelling, Cosmetic Product Regulation, GPSR.
Canada – Health Canada Cosmetic Hot List, Consumer Chemicals Regulations.
Australia – ACCC ingredient bans, mandatory labelling standards.
You must review the official government sites for your destination country before purchase. We make no representation that any product is compliant for your specific end-use or resale unless we expressly state a particular certification on the product page.

6. Shipping & Delivery Estimates

Any lead-time or delivery date given on the Site is an estimate, not a contractual commitment. We are not liable for delays caused by carriers, customs clearance, force-majeure events, or other factors beyond our reasonable control.

7. Arbitration Clause & Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. Any dispute, claim or controversy arising out of or relating to this Privacy Policy, the Terms of Service, your purchase, or any marketing or advertising communication (“Claim”) shall be resolved exclusively by binding individual (non-class) arbitration administered by the China International Economic and Trade Arbitration Commission (CIETAC) in accordance with its simplified-rules then in effect. You and Bath Mira waive any right to a jury trial or to participate in a class action, private attorney-general action or other representative proceeding.

8. Data Sharing & International Transfers

We never sell your Personal Data. We share it only:
With service providers who help operate the Site, process payments, fulfil orders, send e-mails, detect fraud (e.g., Shopify, PayPal, DHL, FedEx).
When compelled by law or to protect our rights.
With your explicit consent.
Your data may be transferred from your country to China and to other jurisdictions where our servers or processors are located.
Applying PIPL security assessments where required.

9. Your Legal Rights
Depending on where you live you may:
Access, rectify or erase your Personal Data.
Restrict or object to certain processing.
Receive an electronic copy for portability.
Withdraw consent at any time (does not affect prior lawful processing).
Lodge a complaint with a supervisory authority (EU/UK), or with the PRC cyberspace administration (China), or with your local data protection authority.
To exercise any right e-mail privacy@bathmira.com. We will verify your identity and respond within 30 days (GDPR) or 15 working days (PIPL) as applicable.

10. California Residents (CCPA/CPRA)
We do not “sell” or “share” Personal Data as defined by CCPA. You may request: (i) categories of data collected; (ii) categories of sources; (iii) business/commercial purposes; (iv) categories of third parties; (v) specific pieces of data. We will not discriminate for exercising CCPA rights.

11. Changes to This Policy
We may update this Policy from time to time. Material changes will be posted on the Site with a new “Effective Date” and, where required by law, we will notify you by e-mail or prominent pop-up.
